These terms apply to all visitors, users, and customers who access or use our photo retouching, stock photography, and custom photography services.

Optivio Studio provides the following services:

• Professional Photo Retouching: Image editing, color correction, skin retouching, background removal, and other photo enhancement services.
• Stock Photography: Licensed stock images available for purchase and download.
• Custom Photography Sessions: Professional photography services for portraits, products, events, and creative projects.

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account and use our services.

Pricing: All prices are in USD and subject to change without notice. The price charged will be the price displayed at the time of purchase.

Payment: We accept major credit cards, debit cards, and other payment methods as displayed on our website. Payment is due at the time of order placement.

Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Taxes: You are responsible for any applicable taxes, duties, or customs fees.

Your Content: You retain all rights to images and files you upload for retouching services. By uploading content, you grant us a limited license to use, modify, and process your content solely for the purpose of providing our services.

Our Content: All content on our website, including text, graphics, logos, images, and software, is the property of Optivio Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Stock Photography: Stock images are licensed, not sold. License terms are specified at the time of purchase and may include restrictions on use, distribution, and modification.

Retouched Images: Upon full payment, you receive full rights to the retouched images for commercial and personal use, unless otherwise specified in your order.

You agree NOT to:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content that infringes on intellectual property rights of others
• Upload content containing viruses, malware, or other harmful code
• Use our services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services or servers
• Resell or redistribute our services without authorization
• Use automated systems to access our services without permission

We reserve the right to remove any content and terminate accounts that violate these terms.

Turnaround Time: Estimated delivery times are provided at the time of order and are not guaranteed. Actual delivery may vary based on project complexity and current workload.

Revisions: We offer unlimited revisions to ensure your satisfaction. Revision requests must be submitted within 14 days of delivery.

Rush Orders: Expedited service is available for an additional fee. Rush delivery times are guaranteed or your rush fee will be refunded.

File Delivery: Completed files are delivered via secure download link. Files are available for download for 90 days after delivery.

In general:

• Orders can be cancelled before work begins for a full refund
• Partial refunds may be available for work in progress
• Stock photography purchases are non-refundable once downloaded
• We guarantee satisfaction or will work with you to make it right

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• Our services will be uninterrupted, timely, secure, or error-free
• The results obtained from using our services will be accurate or reliable
• Any errors in our services will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIVIO STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the liability, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Optivio Studio, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of our services
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Content you upload or submit to our services

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute arising from these Terms or our services shall first be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in Fort Smith, Arkansas, in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination:

• Your right to use our services will immediately cease
• We may delete your account and content
• You remain liable for all amounts due
• Provisions that should survive termination will remain in effect

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of our services after any changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using our services.
